Vivian Garrastegui has been practicing in the field of Elder Law, Medicaid Planning, Asset Protection, Estate Planning, Guardianship Proceedings, Special Needs Planning, Medicaid Fair Hearings, Real Estate, Preparation of Wills and Trusts, Contested and Uncontested Guardianship Proceedings, and Probate and Administration Proceedings since 1987. As an Elder Law attorney her primary focus is to preserve and protect the client’s assets/ resources/income to the extent permitted in accordance with the statutes. She pays great attention to detail when processing the Medicaid Application, advising on transferring assets, preparation of Medicaid Qualifying Trusts and Supplemental Needs.
She drafts Wills and Trusts to suit the diversity and complexity of the financial issues and personal issues of each client. The client’s individual needs range from planning for disabled children (of any age), minor children, disabled spouses, multiple children with different needs and charitable bequests.
She is appointed and re-designated every year by the Presiding Judge of the Appellate Division of the First and Second Departments as a Court Examiner in Guardianship Proceedings to review the Annual Accounts and Final Accounts of Court Appointed Guardians. She is on the New York State Part 36 Fiduciary list of appointments, and is appointed by the Judges of the Supreme Court as Counsel to Guardian, Attorney for Alleged Incapacitated person, Court Evaluator, Receiver, and Guardian ad litem in both the Supreme Court and the Surrogate’s Court.
Vivian has lectured on Elder Law, estate matters, Asset Protection, Medicaid Planning, Special Needs Planning, and Trusts and Estates for local libraries, community centers, Veterans organizations, and the National Business Institute.
Ms. Garrastegui received her Juris Doctorate degree from Brooklyn Law School and her B.A. degree, cum laude, from Long Island University.
